CURRENT ISSUES ON THE BORDER 2014
James has been in contact with everyone on the issue of the border crisis. Citizens who are Hispanics are at the top of his concern. James believes in Natural Original Liberty according to John Locke and the Unites States Constitution. This means you have a right to come here to the United States.
However, because of the illicit behavior of our local and federal governments, and the corporate establishment in the United States of America, in the last many decades, our economy has grown weak. in debt, and inflation is growing every day. The American people are over burdened with regulations, rules, taxes, fees, penalties, interest rates, debt, and ever more increasingly, limited amounts of good paying jobs.
James has been in direct contact with illegals. James grew up with Hispanics in his district and has many life long friends as a result. James's wife is Hispanic, and his son-in-law is from Mexico. In the last three weeks, even though James is working hard to help the Hispanic community, and solve issues in the border crisis, James has been threatened by some Hispanics, and harsh prejudice slurs have been uttered to him in Spanish on more than one occasion.
The American dollar is growing weaker daily, and our nation is over $17 trillion dollars in published visible debt alone. The American people can not sustain an influx of illegals, especially if they will undercut American jobs, or cause an increasing burden on taxpayers and the economy, in sectors of government like the welfare system or schools. We have not even considered the implications of the public schools and the costs it will take to educate an influx of over 35,000 children a month in Texas alone.
After speaking with many on this issue and trying to conclude an unbiased solution, James came to this. The stories and struggles these new migrants have coming to America are amazing. They are triumphs and stories of a desire to pursue Liberty and happiness. We can not take this away from them. In the mix there are some that do not have the same intentions. Some are even very sick. We can not just pretend to defend our constitution and Natural and Original Liberty, and expect that value will defend our own specific pursuits and rights if we express anger, racism, or fear, and take that away from others. However, we can not continue to allow more undocumented people into our country. Especially not knowing their backgrounds, diseases, and intentions. There are reports of individuals with deadly diseases coming in and infecting others. Even those who are crossing borders at the same time are passing these viruses around among each other. There are also reports of drug cartel and gang members crossing into the USA while using little children as a distraction.
"Hispanics in my district have expressed a very deep concern for the children, and many have asked me to help them find ways to adopt these children. These Hispanics are also concerned about the streets in our district, and jobs too. They are struggling, like most Americans are today, and they feel that the new influx of illegals will also take jobs away from natural Hispanic's, or second and third generation Hispanic citizens. They also express to me that they would fear for me walking up and down Uvalde street where I grew up, in fear that a gang member or drug dealer would "rob, shoot, or rape me".
In conclusion. The United Stated can not sustain a population of children who are not adopted. But they should have a chance. We must encourage the churches, especially the churches in Latin America to build places for these children to live and study in common estates where they can learn to farm, and let them help each other learn and grow. The US should put funds to assist in that rather than welfare or programs for new illegals. The influx of potential harmful illegals threatens the Liberty, freedom, and prosperity of ALL Americans. We must express that we DO care for those seeking a life in America, but we must also focus all available funds and personnel to the borders to shut crossing down immediately. We must seal all new crossings. In a way, coming into the United States today is an act of invasion until we can get the influx of illegals, and our economy under control. Still, because the United States is founded on freedom and Liberty, and we are a humane society, we must grant amnesty to all documented illegals immediately. Though, because of the economy, we should not allow illegals granted amnesty any government benefits for at least twenty years after having been granted amnesty, and we should allow and encourage them and their families to leave and return to their homeland, to bring freedom and Liberty there if so desired, penalty and tax free anytime in that twenty year period. But the United States, as currently ruled as an Oligarchy, can not continue to allow new illegals in and give them citizenship until we fix our broken system. I would think that anyone over the age of 17, that crossed in this crisis should be detained and returned immediately.
We should immediately check first for illness and disease on all children who have already crossed and not return them. We should also construct a low cost detention prison in the desert for new adult immigrants who cross illegally until they can be safely transported back to their homeland, or cleared for amnesty because they were here prior to this crisis.
All children should be given a fair chance for adoption and we should NOT prevent the churches and communities from being able to intervene in this crisis situation, but encourage it. To help release the burden, we should forgive and remove all future taxes on religious churches and institutions immediately, especially those who pledge to be involved in helping those in need in this crisis, US citizens, or illegals..
The number one priority should be to completely seal and prevent anyone from crossing any United States border until we can get our economy, and border issue under control. We should immediately stop issuing green cards and visas to ALL those who are planning to come to the United States from any other country until this crisis is resolved.
Suspending NAFTA should be a possible consideration until things settle down.
“We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.”
Amendment 14, Section 1 – “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”
Whenever a question arises concerning an important issue such as immigration, the best and most reliable source for finding what this Nation should do in solving any problem that we face is to look to the Constitution.
While there are only two specific references in the Constitution to immigration , stated in this most important of documents as , “naturalization, ” there is clear evidence by the Framers as to what they intended concerning the rights of the people who live in this country and how those rights affect immigrants both legal and illegal.
The two references in the Constitution that specifically mention , “naturalization, ” are found in Article I, Section 8 in creating the authority of the Congress, “To establish an uniform Rule of Naturalization.” Thus from a Constitutional stand point it is the responsibility of Congress to establish all laws and rules of naturalization or immigration.
The second reference is located in the 14th Amendment shown above stating that , “All persons born or naturalized in the United States,” are, “citizens of the United States and of the State wherein they reside.”
The key thought in the 14th Amendment which along with several other provisions established in the Constitution shows that the intent of the Framers was that only citizens of the United States whether born or naturalized are granted the rights and privileges that are available in America.
While Congress has the Constitutional authority to establish laws of naturalization or immigration they do not have a true Constitutional authority to create blanket legislation that allows non – citizens the rights of born or naturalized Americans. In other words amnesty is technically unconstitutional because it bypasses the laws which are established for immigrants to become American citizens.
The beginning of the Preamble of the Constitution states clearly who gives authority to the government and in whom the rights established in the Constitution belong to and they are,” We the People of the United States.”
The Framers clearly show that the laws governing this country as established in the Constitution and the rights that are available are for citizens of this land. Even the very Representation in our government from the President to the Congress are established that eligibility to hold public office is reserved for citizens only with the President required to be a natural born citizen of The United States and not a naturalized citizen.
Throughout the Constitution our rights are continually shown to be for citizens of the country, even when the word citizen is not specifically mention. The Preamble calling the establishment of the Constitution by, “We the people, ” clearly indicates that each of the rights and privileges as recorded by the Framers are for the citizenry of this country only.
This does not mean that those who immigrate legally to The United States are treated as second class people or that the laws that protect our citizens whether civil or criminal do not afford the same protections and freedoms to all whether citizen or legal immigrant.
But the rights that we have to vote, to speak freely, to worship as we will, to keep and bear arms, protection from illegal search and seizure, all are rights given by authority of the people for the people, the citizens of the land. It then is also established that any of these rights that may be afforded or not afforded to non-citizens are given ONLY by the authority of the people of The United States.
Anyone who enters in or resides in this country has the privilege given by the authority of the people to share in our freedoms and rights. Citizenship though is not a right that is given nor the privileges of citizenship to any immigrant whether legal or illegal until they have been established by the laws of naturalization as Americans.
Birth gives Americans the right of citizenship but to those who immigrate citizenship must be given by the rule of law. The Framers made it very clear that the law must first be satisfied before the rights of citizenship are available. Each Constitutional reference to our rights and privileges are for the people who are the citizens only.
The Framers realized that once the freedoms and liberties that we have in this country became known to the world that The United States would become a melting pot of cultures and nationalities from all over the world. But they also understood the necessity of keeping our identity as Americans and in establishing a uniform rule of law for gaining citizenship in America and having as born and naturalized citizens the rights and privileges as an American!
